技术的进步和社会需求的改变时常对现存法律制度形成挑战,当网络和数字化技术飞速发展,人们对“免费文化”的需求日益高涨,现存版权制度面临着诸多挑战。在进一步强化版权在网络和数字世界的权威,抑或彻底抛弃现存版权体系,重新构建新的市场和商业模式的激烈争论中,版权“中间道路”的研究者们提供了诸多可供参考的思路。本文聚焦于《免费文化》一书的主要观点,来阐述、分析和评价版权保护“中间道路”的内涵、意义及其可行性。
The progress of technology and the change of social needs often challenge the existing legal system.
