当前我国正处于自然灾害频发、社会转轨和经济转型的特殊时期,各类犯罪高发、犯罪数量高位运行致使看守所在押人员爆满、监室不足等情况的发生,迫使处于这种特殊情况的看守所不得已做出将在押人员进行移押的选择。本文对南平市看守所因洪水将全部在押人员以及福州市直两个看守所因爆满将部分余刑犯移押福清看守所的情况两次进行调查与分析,认为如何保障移押罪犯的合法权益,以及移押后如何实行合理有效的管理模式,值得探讨与研究。
