司法实践中,罚金刑刑罚与执行过程中暴露出的随意性和盲目性以及“以刑代罚”、“以罚代刑”、“先罚后判”、“判而不缴”等等诸多不容忽视的问题,影响了罚金刑的实行效果。本文拟从检察监督的视角分析出现上述问题的原因,并从完善罚金刑刑罚与执行监督机制、健全检察机关各部门之间的协作体制等方面来探析拓展检察监督的方法与途径。
In judicial practice, the penalties of fines and the randomness and blindness exposed in the process of execution, as well as the “penalty to penalty”, “punishment for penalty”, “punishment after punishment”, “ Not paying ”and many other issues that can not be ignored, affecting the implementation of fine punishment effect. This paper intends to analyze the causes of the above problems from the perspective of procuratorial supervision and probes into ways and means of expanding procuratorial supervision from such aspects as perfecting the penalty of punishment of penalty and implementing the supervision mechanism and perfecting the coordination system among various departments of procuratorial organs.
