目前,虽然《物权法》、《土地管理法》、《农村土地承包法》等法律都有关于农村土地的规定,但不够清晰、明确,缺乏一定的操作性;而且,现有法律是建立在城乡二元制结构基础上的法律体系,具有一定的滞后性,不能满足土地改革目标的要求。为了进行农村土地改革,实现农村土地与国有土地同等入市、同权同价等目标,必须要有与之相适应的土地法律体系予以保障。建立完善的农村土地法律法规体系,首先要构建农村土地法律体系的基本框架,整合统一相关的法律法规,专门立法。其次,在加紧整合法律法规,专门立法的同时,要加快修改、完善现行法律,并在此基础上进一步完善土地改革的相关配套法规建设。在实施方面,各省市、地区也要结合实情,分别就农村土地改革的各个方面制定具有可操作性的实施细则。这样,形成一套完善的农村土地法律法规体系,实现土地改革的目标,调整农村土地制度创新与统筹城乡发展的良性互动关系,真正实现城乡一体,农村土地与国有土地同等入市、同权同价。
