概率证据对当下刑事审判制度产生了很大的影响,审判中许多事实查明不再简单地依赖和凭借人类的观察和感受,而是大多依靠先进的科学手段来完成。概率证据的运用一方面提高了事实查明的可靠性和准确度,另一方面对法官的自由心证造成了强烈的干涉。如何平衡概率证据与自由心证之间的矛盾,成为了科学证据证明力的关键。概率证据对当下证据制度的影响颇为深远,通过对其适用的评析与未来发展的展望,使之更符合公正与效率的要求。
Probability evidence has a great impact on the current system of criminal justice. Many of the facts ascertained in trial are no longer simply relied upon and relied on human observation and feelings, but mostly rely on advanced scientific methods. The use of probabilistic evidence, on the one hand, increases the reliability and accuracy of fact-finding and, on the other hand, creates a strong interference with the free testimony of judges. How to balance the contradiction between probability evidence and free evidence has become the key to the scientific evidence proving power. Probability evidence has a far-reaching impact on the current evidence system. Through the application of its assessment and the prospect of its future development, it is more in line with the requirements of fairness and efficiency.
