近年来,中国古代的法律渊源成为法律史学界集中关注的学术问题。然而,学界的大部分论述都集中于明清时代,对秦汉时代未能予以足够的重视。事实上,在秦汉时代,虽然朝廷意识形态经历了从法家、黄老到儒家的转变,但传世文献及出土文献都在不同程度上指明,律令治国作为一种基本统治手段并未发生根本性变化。与之相应,律令断罪很可能是秦汉时代审判的基本样态,而儒家思想所阐发的则只是一种政治理想。所谓“王霸道杂之”或“以儒术缘饰吏治”正可从这一点获得证明。
In recent years, the origins of law in ancient China have become the academic issues that the academic circles of law history have focused on.
