背景音乐收费制度在保障创作者和传播者利益的同时,也确保了使用者对作品的使用,但由于收费标准的不合理导致了使用者及社会公众利益受损,同时,权利人也无法通过作品的广泛应用获得利益。本文试图通过对背景音乐收费的法律依据、收费标准进行分析,梳理出其促进与影响多方利益平衡的理论支撑,并提出合理化建议。
