“泉州民营义务教育回收事件”折射出当下我国民营义务教育的诸多困局。在法规范层面,宪法、法律不仅没有禁止民间力量对义务教育事业的参与,而且还有明显的鼓励之意;在法学理论层面,通过对义务教育阶段的政府责任、公民接受可选择义务教育的权利及私人兴学自由的探析,能够为义务教育民营化提供法理基础。与此同时为了实现公私合作义务教育的发展,义务教育民营化的行政法保障显得尤为重要,良好的后续政府监管是未来摆脱民办教育困境的根本之道。
