一般贸易的原产地规则适用于贸易统计时,因不能真实反映国际贸易收支平衡的实际情况,会产生贸易转移、重复计算的弊端,进而导致贸易秩序混乱和扭曲贸易。贸易统计的原产地规则从功能上区别于判断享有贸易地位活待遇的原产地标准,也有别于反规避和政府采购的原产地标准。适用于贸易统计的原产地标准独成一类,只能是从价百分比标准。贸易统计的原产地规则可以通过国际条约和国内立法加以明确。
When applying the rules of origin of general trade to trade statistics, the rules of origin of trade do not truly reflect the actual balance of international trade, resulting in the drawbacks of trade transfer and double counting, which in turn leads to chaos in the trade order and trade distortions. The rules of origin of trade statistics are functionally different from the standards of origin for judging the status of trade enjoyment and also different from the standards of origin for anti-circumvention and government procurement. The origin standards applicable to trade statistics are of a single category and can only be ad valorem percentages. The rules of origin of trade statistics can be clarified through international treaties and domestic legislation.
