《十八届五中全会报告》确定了“二孩政策”在全国范围内实施的原则并引起了《人口与计划生育法》的修改,由此引出政策法律化问题。应该从两个方面即政策法律化的条件与必经程序来厘清法律与政策的相互关系。通过政策法律化来完善社会治理方式,为社会主义和谐社会与法治社会的建设贡献力量。
The Report on the Fifth Plenary Session of the 18th Plenary Session established the principle of implementing the “two-child policy” nationwide and amending the “Population and Family Planning Law”, thus leading to the issue of the legalization of policies. The relationship between law and policy should be clarified from two aspects: the legalization of the policy and the necessary procedures. Through the legalization of policies to improve the way of social governance for the building of a socialist harmonious society and the rule of law contribute to the community.
