按照国家物价局《关于价格违法行为的处罚决定》,对价格违法行为的非法所得,应责令违法单位或个人退还给购买者。不能退还给购买者的,要连同经济制裁罚款一起,由物价检查机构上缴国库。对于这部分由物价检查罚没款形成的财政收入如何使用?我认为,可把这部分资金与保持市场物价稳定挂钩,通过一定的途径,将乱涨价、乱收费等价格违法行为中消费者受到的经济损失,间接返还到消费者手中。
In accordance with the “Punishment Decision on Price Illegal Behavior” of the State Price Bureau, the illegal proceeds of price illegal acts should be ordered to be returned to the purchaser.
